Steven Forrest Baltzell
Steve is a pro-active alternative dispute resolution advocate and practitioner focused on matters prior to or in litigation.
Former insurance company Vice President, with more than 50 years of diverse work experience in claims management, including investigating, evaluating and analyzing liability and economic damage issues in complex matters prior to and during litigation. Strong proponent of early mediation opportunities, as such has participated is over 2000+ mandatory settlement conferences and /or mediation and monitored 100+ jury or bench trials to conclusion.
Excellent listening and communication skills with effective interpersonal and mentoring capabilities. Ability to quickly assess situations. Experience as director of training and human resource development and mentoring programs. Identified, developed and expanded/reduced staff to support organizational objectives. Strong management and analytical skills.
Steve works easily within ever-evolving situations and remains focused on helping move matters forward. He is available in Southern Oregon and Northern California.
LITIGATED MATTERS: Matters already before the court, $250.00 per hour.
NON-LITIGATED MATTERS: Inter-personal non-complex matters (two parties, not reduced to a lawsuit) $175.00 per hour. Complex matters (involving more than two parties, no lawsuit filed) $200.00 per hour.
FEES: Fees are to be shared equally by the parties/sides unless the parties agree to an alternative arrangement.
RETAINER: A $500.00 non-refundable retainer is required at least three business days prior to the scheduled mediation date. The retainer will be applied to the scheduled mediation.
BILLING: Upon conclusion of the mediation, a final invoice will be sent to all parties for the balance owing. Payment of the invoice is expected within 30 days.
PLANNING AND PREPRATION
I will initiate calls to all participants and counsel prior to the scheduled mediation date. Mediation statements are requested at least three business days prior to the scheduled mediation.
If you would like me to consider additional information, please provide any documents/materials three business days in advance of the scheduled mediation. Also, please indicate if any of the documents/materials you are providing can be shared, otherwise they remain confidential.
Any time spent in preparation for the scheduled mediation will be billed at the agreed upon hourly rate.

Approach
My approach is simple:
Be prepared. Review all provided materials. Remain objective throughout the review process and the mediation session, itself. No judgement or preconceived notions.
Maintain an open mind with a natural curiosity.
Focused listening and observation of the parties during the mediation session.
Develop questions as necessary to fully flesh out positions, needs, wants and directions of all parties.
Are the parties in a position to resolve the matter? Is there something missing? Can the missing components be identified, developed, examined, understood and incorporated?
Remain flexible, open and adaptable as new or different information is presented or developed. Remain mindful of the end game. Can a resolution be reached, can gaps be identified and closed. Remain respectful of all parties.
